Terms of Service

1. Who we are

The Refiner ("we", "us", "our") is a service operated by Tiny Red Pixel Ltd, a company registered in England and Wales (Company Number: 17224220) with its registered office at Unit A, 82 James Carter Road, Mildenhall, Bury St. Edmunds, IP28 7DE, England. By using The Refiner you agree to these terms.

2. The service

The Refiner is a web application that processes audio files you upload or submit through supported track links, applies AI-driven restoration or analysis models, and returns results to you. The service is offered "as is" without warranty of any kind.

3. Your account

You must provide accurate information when registering. You are responsible for safeguarding your account credentials. You must be at least 13 years old (or the digital-consent age in your jurisdiction, whichever is higher) to use The Refiner.

4. Acceptable use

You agree not to:

• Upload audio you don't own or don't have explicit license to process
• Submit a third-party track link unless you own or control the track, or are otherwise authorized to have it processed
• Upload audio that infringes any third party's intellectual property, privacy, or other rights
• Use a linked-track feature in a way that violates the source platform's applicable terms
• Use the service to harass, defame, or harm any individual
• Attempt to reverse-engineer, scrape, or abuse the service
• Resell access to the service without our written permission

We reserve the right to suspend accounts that violate these rules. Repeated violations may result in permanent termination without refund.

5. Your content

You retain ownership of all audio you upload and the audio we return to you. By uploading audio or submitting a track link, you represent that you have all necessary rights and permissions and grant us a limited license to retrieve and process the audio solely to provide the requested service. You also represent that doing so does not breach an agreement between you and a third party. We do not train models on your audio. We do not share your audio with third parties except as required to operate the service (e.g. our hosted compute provider, which processes audio in-flight and does not retain it).

Files are deleted 7 days after refinement. Temporary audio retrieved for standalone AI detection are deleted immediately after the analysis request.

6. Pricing and billing

Subscriptions and credit packs are billed in advance via Stripe. Prices are in USD. Subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the current billing period.

Subscription credits expire at the end of each billing cycle (use-it-or-lose-it). Pack credits do not expire.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be billed at the prior rate through the end of their current cycle.

7. Refunds

Refunds for failed refinements are issued automatically as service credits. We do not offer cash refunds for unused subscription time, but exceptional circumstances will be considered case-by-case at support@therefiner.app.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service. We are not liable for losses arising from service outages, model errors, or processing delays.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of your use of the service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these terms. Upon termination, your data is deleted within 30 days, except where retention is required by law.

11. Governing law

These terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the courts of England.

12. Changes to these terms

We may update these terms from time to time. Material changes will be notified by email at least 14 days before they take effect.
